A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date of the final judgment.
Reasons
Punishment of the crime
The defendant is a person who actually operates D, E, F, and G Co., Ltd. established for the purpose of classing ship, etc.
H Co., Ltd. and I Co., Ltd., from around 1998, performed their duties as an agent of the limited international port corporation with limited liability in connection with the vessel operated by the limited international port corporation in Korea.
1. The J served as the Director of the Incheon Office of H stock company and I stock company from 1998 to January 29, 2010, and has been dealt with by being delegated with various cooperative businesses, such as vessel repair related to vessels operated by the short-dong International Port Limited Corporation, and determining the cost of goods and services.
Around July 198, the Defendant made an illegal solicitation to the effect that he would be able to provide the ships operated by the short-dong International Port Limited Corporation with water in D, etc., and that he would have the J be selected as a partner company of the above company, and that he would be maintained as a partner company continuously, and that on April 2002, 11,954,80 won calculated by deducting 5% from 12,584,000 won of the water supply to be paid normally at around 12,584,00 won, which was paid by the J and then had the J personally use 629,200 won equivalent to 5% of the above 5% of the water supply supply amount, from that time, until January 2010 as described in Annex I of the annexed Crimes List I, the Defendant paid 5% of the total amount of 5% of the water supply amount from each month’s normal water supply price or granted 5% of the total amount of 5% of the total amount of the claim to the J Association in cash.
2. K, from February 2010 to February 2, 2010, is holding office as the director of Incheon Office of H stock company and I stock company as the successor of the above J, and the duties of selecting various collaborative companies, such as repair of ships related to vessels operated by the short-dong International Port Limited Corporation, and determining the cost of goods and services.
