Defendant shall be punished by imprisonment for not less than three years and six months.

Punishment of the crime

On July 1, 2016, the Defendant was sentenced to one year of imprisonment for fraud at the Incheon District Court, and the execution of the sentence was terminated on January 29, 2017.

The Defendant came to know K at the first school of the North Korean Dos during the guard, and the Defendant, K, L, etc. around October 2017, the Defendant opened an Internet shopping mall despite the absence or intent to operate a normal Internet shopping mall, posted an advertisement to sell home appliances, and reported the purchase of home appliances.

It was intended to operate a "flopped shopping mall" that only raises funds in the name of the purchase price of goods from contact persons.

Accordingly, the defendant plays a role of directly withdrawing money deposited in the account by providing a deposit account, and K plays a role of managing the overall operation and money of the shopping mall, and L plays a role of allowing a person who wants to purchase the shopping mall to make a telephone call while opening and operating the shopping mall.

1. On January 26, 2018, in collusion with K, L, etc., the Defendant posted a false advertisement stating that he/she sold high-priced household appliances on the Internet at the shopping mall site of “M (M)” and received KRW 870,900 from the victim P to the Nonghyup Bank account (T) account in the name of the Defendant for the purchase price of household appliances on the same day, and received KRW 870,900 from the victim P as the purchase price for household appliances, and received KRW 405 times in total from January 26, 2018 to February 8, 2018 as shown in attached Table 1.

Accordingly, the defendant was delivered property by deceiving victims in collusion with K, L, etc.

2. On January 26, 2018, the Defendant attempted to commit fraud, in collusion with K, L, etc., sells high-priced household appliances on the Internet at “M (N)” shopping mall sites opened on the Internet.
