A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Reasons

Punishment of the crime

1. The Defendant is a person who is engaged in driving on board CK5 cars in violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (i.e., escape vehicles) and the Road Traffic Act (ii).

On April 3, 2016, the Defendant driven the said car under the influence of alcohol content of 0.138% in blood around 09:51 on April 3, 2016, and led to the driving of the said car on the surface of 0.138% in front of every driving distance, which is in the principle of the Eup/Myeon of Gyeongbuk-gun, Pacific-gun.
