A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

【Criminal Power】 On July 24, 2007, the Defendant issued, at the Daejeon District Court, a summary order of KRW 700,000 as a fine for a violation of the Road Traffic Act, and on April 12, 2013, a summary order of KRW 4 million as an identical crime in the same court.

【범죄사실】 피고인은 2019. 12. 28. 01:22경 대전시 유성구 구즉로에 있는 공영주차장 내 약 20m 구간에서, 술을 마신 상태로 B 카니발 하이리무진 승용차를 운전하다가 주차된 차량을 들이받는 교통사고를 일으켜, ‘음주운전을 하는 것 같다, 여기저기 충격하고 있다’라는 취지의 112신고를 받고 현장에 출동한 유성경찰서 C파출소 소속 경위 D로부터 피고인의 보행상태가 비틀거리고, 언행 상태가 어눌하며, 혈색이 붉고 술냄새가 많이 나는 등 피고인이 술에 취한 상태에서 운전을 하였다고 인정할 만한 상당한 이유가 있어 같은 날 02:10경부터 02:30경까지 사이에 3회에 걸쳐 음주측정기에 입김을 불어 넣는 방식으로 음주측정에 응할 것을 요구받았음에도 음주 측정기에 입김을 불어 넣는 시늉만 하는 방법으로 정당한 사유 없이 이를 회피하였다.

As a result, the defendant violated Article 44 (1) or (2) of the Road Traffic Act on not less than two occasions by failing to comply with a police officer's request for alcohol measurement without any justifiable reason.
