Defendant
A shall be punished by imprisonment with prison labor for six months and by imprisonment with prison labor for ten months.
However, as to Defendant B, this shall not apply.
Reasons
Punishment of the crime
The Defendants of the 2018 Highest 928, 198, left the victim's goods located in the victim C's residence living together with the Defendant, and conspired to divide them into money by selling them.
1. The crime of around 21:00 on May 16, 2018, Defendant A made phone call to Defendant B and brought it to Defendant B, and Defendant B conspireded with “C (victim) by stealing the satis in the residence of the victim,” and Defendant B conspired to sell the satis in the victim’s satisfy to another person upon Defendant B’s consent. On May 16, 2018, Defendant B conspired to sell the satisfy in the victim’s residence within the Silsan-si, Silsan-si, Silsan-si, Seoul, with a 700,000 high satisfy amounting to KRW 70,00,00,000, which is the victim’s market price at around the above residence.
As a result, the Defendants conspired to steal the property owned by the victim.
2. On May 16, 2018, Defendant A proposed that Defendant B “if there remains any article to be brought about in the C (victim)’s residence” to Defendant B, and Defendant B consented thereto.
The Defendants, at around 23:00 on the same day as the statement in paragraph 1, opened the victim’s residence door, and Defendant A had 1 set up the victim’s market value equivalent to 300,000,000 won.
Accordingly, the Defendants committed a theft of the property owned by the victim jointly.
On June 27, 2018, 2018, Defendant B, a single criminal defendant, opened a window installed on the outer wall of a building on his/her hand in order to bring one unit of the main body of a computer located on his/her own at the time of residing together with the victim C (n, 17 years of age) who was living together with the victim at around 1:38 on June 27, 2018, in order to bring about one unit of the main body of the computer that was located on the outside wall of the building, and harming the peace of residence by putting the window installed on the bend side of the building into the front part.
