Defendant A shall be punished by imprisonment with prison labor for one year and by imprisonment for eight months, respectively.

However, as to Defendant B, this shall not apply.

A is the driver of the E-Syna individual taxi, and the defendant B is the driver of the Fyna other taxi.

1. 피고인 A 피고인은 2017. 2. 10. 23:15 경 전주시 완산구에 있는 뱅뱅 앞 도로에서 피고인의 개인 택시에 피해자 G( 여, 25세 )를 태우고 객사 방면에서 진북 광장 방면으로 편도 2 차로의 도로를 시속 미상의 속도로 자신의 차선을 넘어 두 개의 차로로 진행하게 되었고, 피고인의 후방에서 진행하던 피해자 B가 운전하는 F 쏘나타 택시가 피고인의 택시를 향해 상향 등을 키고 경적을 울리며 진로를 방해하지 말 것을 경고 하였음에도 피고인의 택시가 비키지 않자 위 B는 피고인의 택시를 추월한 후 피고인의 택시 앞에서 급격히 속도를 줄이며 위협을 한 후 속도를 높여 달아났고, 이에 피고인은 화가 나 위 B의 택시를 향해 상향 등을 켜고 신호를 2회 위반하며 추격하고, 2017.2. 10. 23:18 경 같은 시 덕진구 심 방죽로 16에 있는 선변 아파트 앞 편도 1 차로의 도로에서 위 B의 택시가 피고인의 차량 앞에서 고의로 급정지를 하자, 피고인은 사고를 피하기 위해 급정지를 한 후 택시의 속도를 높여 황색 실선의 중앙선을 넘어 B의 택시 앞으로 급하게 끼어들어 B의 택시가 피고인의 택시를 미처 피하지 못하고 B의 택시 좌측 앞 범퍼 부분으로 피고인의 택시 우측 옆 펜더 부분을 들이받게 하였다.
