1. The plaintiff's claims against the defendants are all dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. On June 20, 2016, the Plaintiff entered into a lease agreement with Defendant B, a licensed real estate agent, as the broker of Defendant C and the broker, with respect to the lease deposit for KRW 50 million, monthly rent of KRW 50 million, and the lease term from July 20, 2016 to July 20, 2018, with respect to the general steel structure and other sloping roof (sloping roof) of a factory building of KRW 990,00 (hereinafter “instant building”). Under a special agreement, the lessee entered into a lease agreement with the lessor to report the change under the lessor’s consent and to restore the building to its original state at the time of the termination of the lease (hereinafter “instant lease agreement”).
B. The Plaintiff entered into the instant lease agreement to use the instant building for resource circulation facilities. On the date of entering into the instant lease agreement, H employee I, a designer, was present to change the purpose of use of the instant building. On that spot, the Plaintiff entered into a service agreement with H for granting authorization for change of purpose of use of the instant building.
C. H received a written consent to land use and a written consent to the use of a building from E and applied for a change of the use of the instant building to a resource circulation facility, but the fluent viewing demanded supplementation of civil petition documents against the said application.
H responded to the reply that the division of the site of the instant building is necessary for the alteration of the purpose of use of the instant building from the competent authority. On October 2016, 2016, H signed and sealed an agreement with the purport that E would attempt to divide the site of the instant building for the alteration of the purpose of use of the Plaintiff’s side and delivered it to the Plaintiff.
E. Meanwhile, Defendant D Association (hereinafter “Defendant Association”) is in accordance with the Licensed Real Estate Agent Act by causing property damage to the parties to a transaction by intention or negligence in mediating real estate transactions between Defendant C and Defendant C during the mutual aid period.
