Reasons
Punishment of the crime
[criminal history] On October 31, 2008, the Defendant was sentenced to imprisonment with prison labor for special larceny at the Seoul Northern District Court on March 22, 2013; imprisonment with prison labor for larceny at the Seoul Central District Court on March 22, 2013; imprisonment with prison labor for two years; and imprisonment with prison labor for two years at the same court on June 18, 2014; and imprisonment with prison labor for one year and ten months at the Suwon District Court on February 14, 2017; and completed the execution of the sentence at the Southern Prison on July 6, 2018.
[Criminal facts]
1. From around 01:30 on July 22, 2018 to around 03:00 on the same day, the Defendant: (a) laid off the 7th floor of the B B building in Bupyeong-si B, 03:00 on the same day; (b) the victim D was able to use a creb and cut off one cell phone with the victim’s market value equivalent to KRW 800,000,000, the victim’s market value on the part of the victim.
2. On July 22, 2018, from around 04:12 to around 05:13, the Defendant: (a) in the 6th floor “F” room of the E building in Bupyeongcheon-si; (b) the victim G dykes the victim’s dyke by crebing the victim’s market value equivalent to KRW 900,000,000,000,000 in the victim’s jugth by crebling the victim’s dyke.
3. From around 05:00 on July 23, 2018 to around 06:00 on the same day, the Defendant: (a) in the 8th floor of HA in Ansan-si building in Ansan-si; (b) in the victim’s body room, a locked victim used a creb and stolen the victim’s body, one cellphone with the victim’s cellphone in the amount of KRW 900,000 (i.e., “Aphone 8s” in the victim’s body room at the victim’s head.
4. From around 09:00 on July 23, 2018 to around 12:00 on the same day, the Defendant: (a) laid down one cell phone with the victim’s market value equivalent to KRW 800,000,000, in the first floor “K” of the J building in Guro-gu Seoul, Guro-gu, Seoul, by taking advantage of the gaps in which the victim was locked; and (b) cut off the victim’s cell phone with one cellphone in the amount of KRW 800,000,000 in the victim’s market value.
5. The Defendant, from around 03:00 on July 24, 2018 to around 07:00 on the same day, is within the 3rd floor of the Busan Jin-gu Lin-gu Busan Metropolitan City (M), where the victim N is locked.
