1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

Details of the disposition

On June 2, 2012, the Plaintiff entered the Republic of Korea with the spouse visit (C-3) status on June 2, 2012, and applied for refugee recognition to the Defendant on September 3, 2013.

On January 24, 2014, the Defendant rejected the Plaintiff’s recognition of refugee on the ground that there was no “a well-founded fear of persecution” (see Article 2 subparag. 1 of the Refugee Act) from the Plaintiff.

(hereinafter “instant disposition”). On February 20, 2014, the Plaintiff filed an objection with the Minister of Justice on February 20, 2014, but was dismissed on September 30, 2014.

The terms used in this Act shall be defined as follows:

1. The term "refugee" means a foreigner who is unable or does not want to receive protection from his/her country of nationality due to well-founded fear that he/she may be injured on the ground of race, religion, nationality, status as a member of a specific social group, or political opinion, or who is unable or would return to the country in which he/she resided before entering the Republic of Korea due to such fear (hereinafter referred to as "beneficial country");
