Punishment of the crime

1. Defendant A

A. The Defendant violated the Pharmaceutical Affairs Act, through an Internet site, etc., intended to sell fake medicine by advertising a mobile phone text message containing the content of “G” to an unspecified number of unspecified persons by advertising various kinds of origin donation agents and circumstance delay systems, and sales of illegal drugs, such as PEVITA, PEIGY, FIRENTS, etc., as indicated in attached Table 1, such as LEVITA, PEIGY, and FIRENTS, or by advertising a mobile phone text message containing the content of “G”, etc.

Accordingly, around August 6, 2012, the Defendant sold medicines, such as fake vilass, to I, who had reported and contacted the above advertisement at the Defendant’s home located in Jung-gu Seoul Metropolitan Government H, and received KRW 80,000 from the price to the Defendant’s account in the name of the Defendant. From the above date to July 26, 2016, the Defendant sold medicines such as fake vilass, etc. over a total of 3,821 times, as indicated in attached Table 2, and transferred the total sales price of KRW 621,06,380 to the said Nonghyup’s account and the post office account (Account Number K), etc. in the name of the said Nonghyup Bank and C. Based on the market price of KRW 1,1830,000,000, total market price of KRW 167,7708,700,000.

As a result, the Defendant sold drugs even though he is not a pharmacy founder, and acquired and stored drugs for the purpose of sale.

B. The Defendant violating the Trademark Act 1-A
