Reasons
1. Details of the disposition;
A. The Plaintiff was appointed as a teacher on March 9, 1981, and served as an assistant principal of B middle school from September 1, 2012 to February 2015, and served as a assistant principal of C middle school from March 2015.
B. On October 20, 2014, the Defendant issued a disposition of salary reduction for three months against the Plaintiff (hereinafter “instant disposition”) on the ground that the Plaintiff’s act of misconduct, as seen below, violates Articles 56 (Duty of Good Faith) and 63 (Duty of Maintenance of Dignity) of the State Public Officials Act, and constitutes grounds for disciplinary action under Article 78(1)1 of the State Public Officials Act.
Although the Plaintiff is a public educational official who is in the middle school B and is obliged to comply with the laws and regulations as prescribed by the State Public Officials Act, the Plaintiff newly drafted a training log for the above period on February 2, 2013, and prepared a document preparation program by changing some of 22 hours (10~30 minutes) from the original, different from the original, and then delivered the Plaintiff’s signature and the Plaintiff’s decision-making approval, without omitting the approval from the supervising teacher D.
(2) On July 30, 2014, the Plaintiff submitted a life guidance book with documentary evidence of excess work. On July 11, 2014, the Plaintiff instructed the relevant teacher to prepare for a comprehensive audit for seven months, and among them, forged the Non-school life guidance activities on February 12, 2013 to February 22, 2013 to make the Non-School life guidance activities on behalf of the Educational Affairs Administrative Agent F.
On February 14, 2014, H’s mother, who was a student of G on February 14, 2014, did not ask his/her opinion to calculate the total meal cost (508,000 won) of the faculty.
(4) Students who received scholarships of KRW 200,000 due to H activities around November 2013, 201 (hereinafter referred to as “third-party misconduct”) shall be rice culture.
