1. The defendant shall be the plaintiff.
A. As to the shares of 26.75/62 of the buildings listed in the attached list 1, the attached list 209.9.
Reasons
1. Basic facts
A. Each building (hereinafter “each building of this case”) indicated in the attached Tables 1 and 2 on the ground (hereinafter “each building of this case”) on the ground of the 7,718m2 in Daegu North-gu, Daegu-gu, which is the joint ownership of Defendant C, D, D, E, F, and G (hereinafter “instant land before the instant partition”) before the partition was constructed. Each building of this case was not registered separately, and as regards the portion of 1/62 of each building, the registration of ownership transfer was completed in the Defendant future with respect to the portion of 1/16 as to the portion of 4, E, and 12/62 of the building.
B. Some co-owners of the instant land and each of the instant buildings, including the Defendant, filed a claim for partition of co-owned property against G, the remaining co-owners of the instant land and the instant building, as the case of partition of co-owned property in this court 99Gahap12790, but on August 5, 2000, a voluntary adjustment was established with the content that the land prior to the instant partition is divided into G, and 1,905 square meters as to the land prior to the instant partition; 542.5 square meters as owned by C; 1,377 square meters as owned by F; 605 square meters as owned by K, L, M, and N; 605 square meters as owned by K, M, 759 square meters as owned by the Defendant; 542.5 square meters as owned by G (hereinafter referred to as the “voluntary adjustment”).
C. Pursuant to the content of the instant voluntary adjustment, the land prior to the instant partition was divided into 542 square meters in the O, 1,759 square meters in the Plux, Qous 543 square meters in the Qous 547 square meters, 1,377 square meters in the Rlux, 605 square meters in the Slux 605 square meters in the land, and 987 square meters in the land, and the remaining 1,905 square meters in the land (from the following: “the land after the instant partition”; “each of the instant lands” was added to each of the instant divided lands, and the ownership transfer registration was completed on November 29, 2005 in the future by the Defendant on November 1, 2005.
Each building of this case is divided into each land of this case.
