A defendant shall be punished by imprisonment for two years.

However, the execution of the above punishment shall be suspended for a period of three years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant is a person who became a financial director of a victim company E (hereinafter referred to as “victim company”) in 2001 and was in charge of accounting affairs. From around 2002, the Defendant worked as a financial director of the victim company and has overall control over the disbursement and management of the company’s funds.

On February 4, 2008, the Defendant transferred KRW 200,00,00 to the new bank account (number : I; hereinafter “H”) of H (hereinafter “H”) from the victim company’s new bank account (number : G; hereinafter “the new bank account of the victim company”) that he manages under the processing name of “the credit account”, and continuously embezzled the Defendant’s new bank account (number : J; hereinafter “new bank account”) from the H’s new bank account that he manages under the processing name of “goods large” to the Defendant’s new bank account (number : J; hereinafter “Defendant’s new bank account”) from the Plaintiff’s new bank account that he manages. After transferring KRW 200,000,000 to the Defendant’s new bank account (hereinafter “Defendant’s new bank account”).

Defendant embezzled 2,223,176,220 won in total among the 111 times from around that time to June 2, 2014, including embezzlement of 200,000,000 won in the funds owned by the victim company as above, and embezzled 2,23,176,220 won in total as indicated in the list of crimes.

[Crimes List] The amount of temporary embezzlement (unit: original (unit): 12008-02-04 200,000,000 credit amount) is not set. Although there is no credit amount of 1208-04 200,000,000 credit amount, H’s new bank account from the 1st bank account of the victim company to the h’s new bank account under the name of credit amount, H’s new bank account on the same day as the h’s new bank account under the name of the Defendant’s goods substitute, and h’s new bank under the name of goods. Since there was no credit amount of 2208-04-00,000 credit amount used for the construction cost of commercial buildings to be privately constructed by K, there was no credit amount of 2208-04-0140,000,000 credit amount in private.
