1. The Defendant’s KRW 992,376,860 among the Plaintiff and KRW 678,048,707 among the Plaintiff, shall be KRW 306,252,303.
Reasons
1. Basic facts
A. The relationship between the parties (1) The Plaintiff is an autonomous management body consisting of occupants to manage the 1,018 generation and ancillary facilities of Suwon-si, Suwon-si, Suwon-si A Apartment (hereinafter “instant apartment”).
(2) The Defendant is the project implementer who constructed and sold the instant apartment, and the Defendant’s Intervenor C Co., Ltd. (hereinafter “ Intervenor C”) is a contractor awarded a contract with the Defendant for the new construction of the instant apartment. The Defendant’s Intervenor A Co., Ltd. (hereinafter “Supplementary Intervenor C”) is the subsidiary Plaintiff Co., Ltd., and the Defendant’s subsidiary elevator Korea Co., Ltd. was awarded a subcontract with each Intervenor C for the installation of the elevator among the new construction of the instant apartment.
B. (1) The instant apartment was inspected on November 6, 2008, and the Intervenor C did not construct the part to be constructed in accordance with the design drawing regarding the instant apartment, or changed its construction differently from the defective construction or design drawing.
(2) From November 2, 2009, the Plaintiff continuously requested the Intervenor C to repair the defects at the request of the occupants and sectional owners of the instant apartment complex from November 2, 2009, and the Intervenor C also performed the repair work for some defects. However, the instant apartment complex still has the same defects as the specifications in the calculation table by the defect list of attached Table 1 (i.e., each section for common use of the complex and each section for exclusive use) and attached Table 2, and the cost of the same amount as indicated below is also required to repair the apartment complex.
