A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. 피고인은 2019. 4. 2. 19:40경 대구 중구 B에 있는 C 앞에서 ‘술 드시고 와서 행패를 부리는 사람이 있다’는 내용의 112 신고를 받고 출동한 대구중부경찰서 D지구대 경위 E, 경장 F 및 지원무전을 받고 출동한 같은 지구대 소속 G으로부터 사건경위와 인적사항을 질문 받고 귀가 요청을 받자 위 G에게 “너는 누구냐, 내 아들이네, 씨발놈아. 이 새끼”라는 등의 욕설을 하고 오른발로 위 G의 좌측 사타구니 부위를 1회 걷어찼다.

2. 피고인은 제1항 기재와 같은 날 21:03경 제1항 기재와 같은 이유로 현행범 체포되어 대구 북구 원대로 100에 있는 대구북부경찰서 H 사무실로 구인되어 대기하던 중, 유치장 출입문을 열고 있는 대구중부경찰서 소속 경사 I에게 “이리 와 보라”라고 말하여 위 I이 피고인에게 다가오자 발로 위 I의 우측 사타구니 부위를 1회 걷어찼다.

Accordingly, the defendant interfered with the handling of 112 reported cases by police officers and legitimate execution of duties concerning arrest and detention after arresting a flagrant offender.
