1. The Defendant’s KRW 880,866,271 as well as 5% per annum from December 30, 2015 to July 19, 2017 to the Plaintiff.
Reasons
1. Basic facts
A. Status 1 of the parties concerned ) The plaintiff is the Geumcheon-gu Busan Metropolitan Government A apartment (hereinafter "the apartment of this case").
In order to manage 514 households, Act on the Ownership and Management of Aggregate Buildings (hereinafter “Act on the Ownership and Management of Aggregate Buildings”) is applicable.
(2) The Defendant is a project proprietor who newly constructed and sold the instant apartment, and the Intervenor joining the Defendant (hereinafter referred to as the “ Intervenor”) is a new apartment construction contractor awarded a contract with the Defendant for the construction of the instant apartment.
B. On October 30, 2012, the Defendant approved the use of the instant apartment, which was approved by the head of Geumcheon-gu Busan Metropolitan Government for the use of the instant apartment, and around that time, the instant apartment was delivered to the sectional owners, respectively.
C. On February 14, 2014, the Plaintiff: (a) on February 14, 2014, 512 households excluding Edong F and G Dong H units among the 514 households of the instant apartment complex (hereinafter “transfer household of this case”).
(2) The Defendant was entrusted with the authority to notify the Defendant of the transfer of the claim in lieu of the repair of defects from the sectional owners, and notified the Defendant of the transfer of the claim in writing as of October 24, 2014. The Defendant received the above notification on November 7, 2014. (2) The entire area of the instant apartment is 514 households in total, and the number of households of the instant apartment is 46,123.526 square meters in total. Of them, the total area of the entire ownership of the transferred household of this case = 45,953.7636 square meters = 46,123.526 square meters - E-dong F.
