The appeal is dismissed.
Reasons
The grounds of appeal are examined.
According to the records, the defendant appealed against the judgment of the first instance and asserted only unfair sentencing on the grounds of appeal.
In such a case, the argument that the judgment of the court below erred in the misapprehension of legal principles as to murder intention and mental and physical weakness is not a legitimate ground for appeal.
Examining the record in accordance with the relevant legal principles, the lower judgment did not err by misapprehending the legal doctrine, as otherwise alleged in the foregoing.
Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
