A defendant shall be punished by imprisonment for one year.
Reasons
Punishment of the crime
1. Around May 22, 2012, the Defendant against the victim C made a false statement stating that the Defendant had a debt of KRW 30 million at the Victim C’s house located in Yangju-si, Yangju-si, 101 and KRW 30 million, and that even if he/she borrowed money due to no particular revenue or property, he/she did not have any intent or ability to repay it, and that he/she received KRW 5 million from the victim via the Agricultural Cooperative Account in the name of E (F) around May 22, 2012, and acquired KRW 13 million in total from around that time to April 9, 2015, as indicated in the attached Table 1 of the Crime List.
2. Around January 21, 2013, the Defendant against the victim G made a false statement that “The Defendant was liable for KRW 40,000,000 to the victim G located in Yangju-si, D apartment house 103 Dong 704 at the time, and the Defendant acquired KRW 35,50,000,00 in total seven times from that time from that time to December 9, 2014, as shown in the attached Table 2, even though the husband did not have any specific revenue or property since there was no intention or ability to repay the loan to the Plaintiff even though the husband did not have any business funds to operate the deceased factory.”
3. On May 15, 2013, the Defendant against the victim H was liable for approximately KRW 60 million at the time, and even if her husband borrowed money due to the lack of any import or property, such as the absence of a factory operation, etc., in a restaurant where it is difficult to identify the trade name of her Government Dong at the time of her Government, the Defendant borrowed money to the victim H even though her husband did not have any intent or ability to repay the said money, the Defendant did not have any intention or ability to repay the said money. The Defendant borrowed money to the victim H as it is necessary to graduate from her graduate from her school, and it is necessary to pay money to replace the machinery of her husband’s factory.
