성명불상자 1(메신저 위챗 대화명 ‘E', 이하 ’E'라고 함)은 중국, 대한민국 등에서 한국인을 범행 대상으로 한 전자금융사기단을 조직하고 속칭 ’보이스피싱‘등 전자금융사기범행의 대상자들에게 연락하는 전화유인책, 속칭 ’대포통장‘ 확보책, 인출책 등 전자금융사기단 조직원들을 관리하고 피해자들로부터 편취한 금원을 배분하는 등 본건 사기단을 총괄적으로 관리ㆍ운영하는 사람이고, 성명불상자 2(위챗 대화명 ’F‘, 이하 ’F‘이라고 함)는 대한민국 내에서 ’대포통장‘ 확보책, 인출책 등을 관리하는 사람이며, 피고인 A은 2016. 10. 11.경부터 'E’와 ‘F’의 지시 하에 ‘대포통장’을 퀵 서비스 기사로부터 전달받아 ‘F’에게 전달하다가 2016. 10. 13.경부터는 위 전자금융사기단의 역할 및 범행 내용들을 상세히 알게 된 후 추가로 ‘대포통장’에서 보이스범행의 피해금을 인출하여 ‘F’에게 전달하는 역할을 하고, 피고인 B은 2016. 10. 17.부터 'E’와 ‘F’의 지시 하에 피고인 A이 망을 보는 동안 ‘대포통장’을 퀵 서비스 기사로부터 전달받아 피고인 A에게 전달하는 역할을 하는 사람이다.
