1. Facts of recognition;

A. C Co., Ltd. (hereinafter “C”) intended to implement an urban development project (hereinafter “instant project”) in the quasi-agricultural and forestry area located in the Gdong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong (hereinafter “C”) for this purpose, since the agreement was concluded with the E Development Promotion Committee organized by landowners on January 9, 201 to implement the instant project,

B. As to the instant project, the Defendant and C drafted an agreement for the financing of land costs, etc. (hereinafter “Agreement on March 9, 2002”), the date of preparation was March 9, 2002, and the said agreement contains the content that “A performs duties as an entity promoting the financing of the instant project, and the Defendant performs duties as a prospective entity for the purchase of the instant development site.”

C. On May 21, 2002, C, including the Defendant, drafted an implementer seven companies, trust companies, financial institutions, construction companies, and three construction companies, and an agreement on the promotion of the instant business (hereinafter “Agreement”) as of May 21, 2002. The said agreement includes details concerning the implementer, trust companies, financial institutions, construction companies, division of work roles in connection with the construction of multi-family housing and the conduct of the sales business within the instant project zone, the method of the instant project, the raising, execution, and repayment of funds, and the progress and sale of construction.

C In the process of running the instant business, due to financial difficulties, etc., after November 2002, C consulted with the Military Mutual Aid Association and the Investment Attraction, etc. Around November 2002, the Military Mutual Aid Association requested KRW 10 billion and KRW 10,000 in return for the transfer of the instant business rights to the Military Mutual Aid Association, and the Military Mutual Aid Association (hereinafter “B”) around February 2003.
