Reasons
1. Basic facts
A. On November 28, 2001, 201, the Plaintiff completed the registration of transfer of ownership on the instant land by Suwon District Court’s receipt of the name registry office for the Suwon District Court’s Branch, No. 69998. 2) New Cancer Co., Ltd. on January 4, 2002, the registration of transfer of ownership was completed on the ground of sale as of November 26, 2001 by Suwon District Court’s receipt of the name registry office for the Suwon District Court’s U.S. Branch Branch, No. 69999, Jun. 4, 2002.
3) On February 22, 2013, F filed a lawsuit against New Cancer seeking the implementation of the procedure for the registration of cancellation of ownership transfer as described in paragraph (2) above, and obtained a favorable judgment, and the said judgment became final and conclusive (Seoul High Court Decision 2005Na49586, Apr. 18, 2006), and on February 22, 2013, F cancelled the registration of ownership transfer as described in paragraph (2) above. (4) On February 22, 2013, the Seoul High Court Decision 2008Na7126, Seoul High Court Decision 2008Na71126, F completed the registration of ownership transfer for each part of the instant site under the name of Suwon, H, I, K, L, M, and N under the title receipt of the broad Branch Branch of the Suwon District Court of Korea Branch Branch on February 22, 2013.
5) Of the instant land owned by F, F completed the registration of ownership transfer for the Plaintiff on February 22, 2013 with respect to the portion of 334.94/457.8 of the instant land, which was the subject of dispute between the Plaintiff and the Defendants among the buildings of 334.94/457.8 (hereinafter “instant building”) and the real estate indicated in the separate sheet Nos. 1 through 5 is each of the real estate listed in the separate sheet No. 5597, which was the subject of dispute between the Plaintiff and the Defendants, among the real estate listed in the separate sheet Nos. 1 through 5.
2) Defendant B completed the registration of transfer of ownership on August 21, 2002 with respect to each of the real estate listed in the separate sheet Nos. 1 through 4 by Suwon District Court No. 59019 on August 21, 2002.3) Defendant C shall receive the name of Suwon District Court for the real estate listed in the separate sheet No. 5 on April 26, 2002.
