A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.

Criminal facts

Around May 26, 2012, the Defendant entered into a real estate lease agreement with the victim D as the lessee of the victim’s father-gu, Bupyeong-gu, Incheon, Bupyeong-gu, Incheon, by making the victim’s father-gu, his/her father-gu, as the lessee of the victim’s father-gu, KRW 300,000,000,000,000,000,000,000,0000,000,0000,000,0000,000,000,000,000,000,000,000,000,000,000,000,0000,000,000,000,000,000,000,000,000,000 won.

However, in fact, the above C had been owned by the Bupyeong-gu Office and provided that it is prohibited to sublease, transfer, sell, or offer security to a third party. After December 31, 2012, the Defendant was well aware of this fact, as it was no longer possible to lend a loan in accordance with the business plan of the Bupyeong-gu Office.

The Defendant, by deceiving the victim as such, received KRW 6 million from the victim as a check, under the name of monthly rent deposit for subparagraph 3 and building repair expenses, and KRW 900,000 from one bank account under the name of the Defendant, and transferred KRW 3 million to the account under the name of F for monthly rent and premium for subparagraph 2, and received KRW 3 million from the above C to the account under the name of F for the above C C as a monthly rent and premium for subparagraph 1, and received KRW 6,20,000 from the bank account under the name of G for the purpose of the monthly rent deposit for and monthly rent for subparagraph 1.
