1. The Plaintiff (Counterclaim Defendant) paid KRW 49,550,950 to the Defendant (Counterclaim Plaintiff) and its related amount from January 12, 2017 to February 16, 2017.

On December 27, 2014, the Plaintiff entered into a contract (hereinafter “instant contract”) with the Defendant to contract the Defendant for the new construction of the Guro-si Multi-Family Housing (hereinafter “instant multi-family housing”) with the Defendant for KRW 560 million (hereinafter “instant construction”).

(However, the instant contract states the contractor as D (E) and the Defendant as the guarantor. The Defendant, without registering the construction business under the Framework Act on the Construction Industry, filed a report with the contractor under the name of F Co., Ltd. and completed the instant construction work on or around June 26, 2015.

As indicated below, the Plaintiff paid KRW 552,641,00 to the Defendant with respect to the instant construction work. The amount includes KRW 12,200,000 design cost, supervision cost, KRW 4.2 million, elevator installation cost, KRW 25,641,00, and KRW 11,09,420 that the Defendant returned to the Plaintiff as a premium for defect repair insurance.

The sum of the above design cost, supervision cost, elevator installation cost, and return cost of KRW 52,940,420 is about KRW 49,700,580.
