A defendant shall be punished by imprisonment for two years.
Reasons
Punishment of the crime
On November 16, 2017, the Defendant sentenced the Gwangju District Court to imprisonment with prison labor for a crime of fraud and on March 13, 2019, and completed the execution of the sentence in the interesting prison on March 13, 2019.

1. On May 2, 2019, around 00:20 on May 2, 2019, the Defendant had the same attitude to pay the drinking value within the main point of “C” located in Seo-gu, Seo-gu, Gwangju, and ordered the victim D, a business owner, to provide alcohol.

However, the defendant did not have the intention or ability to pay the telecom, and he did not promise to bring about the telecom.
Nevertheless, the Defendant, as above, by deceiving the victim, received 808 guest rooms from the victim, and did not pay 60,000 won for the telecom, thereby acquiring the pecuniary benefits of the same amount.
3. On May 5, 2019, the Defendant, at around 17:00, sent the same attitude to pay the food value at the “H” restaurant located in Seo-gu, Seo-gu, Gwangju, and ordered the victim I, a business owner, to file an order.
However, the defendant did not have the intention or ability to pay the food value.
Nevertheless, as above, the Defendant: (a) by deceiving the victim; (b) received from the victim the two-person portion of Eburica 2, and the one-person portion of the seed coats; and (c) did not pay 32,000 won for food; and (d) obtained pecuniary benefits equivalent to the above amount.
