1. All appeals filed by the plaintiffs are dismissed.
2. The costs of appeal are assessed against the Plaintiffs.
The purport of the claim and appeal is the purport of the appeal.
Reasons
1. The details of changes before and after the determination of the replotting of land owned by I based on the facts I are as follows:
The reasoning for the court’s explanation on this part of JV L,OG K, NW RST X P,Y AF AF AG after the land substitution becomes final and conclusive before the land substitution becomes final and conclusive is as stated in the reasoning of the first instance judgment, and thus, it is acceptable in accordance with the main sentence of Article 420 of the Civil Procedure Act.
2. The assertion and judgment
A. The gist of the plaintiffs' assertion 1) I, the former owner of the land of this case, and the current owners, even though they did not waive their exclusive and exclusive rights to use the land of this case, they obtained profits equivalent to the rent by occupying and using the land of this case without any justifiable title, and thereby, incurred damages equivalent to the same amount to the plaintiffs, who are their owners. Therefore, the defendant is obligated to return unjust enrichment equivalent to the rent for the land of this case to the plaintiffs. 2) The former owner of the land of this case, the first owner of the land of this case, filed an application for designation of the land substitution for replotting for the land of this case among the previous land, and provided the remaining land as a passage for the purpose of designating the land substitution for replotting for land of this case, and the plaintiffs acquired their ownership with the knowledge of such circumstances.
Therefore, the Plaintiffs cannot assert the exclusive and exclusive right to use the instant land.
B. In light of the following circumstances, prior to whether Determination 1 I renounced the exclusive and exclusive right to use the instant land, and the overall purport of the evidence and arguments, I provided the instant land as a road for the purpose of the effective use and profit-making or increase in its value of the instant land owned by himself/herself.
