Defendants shall be punished by imprisonment for one year and six months.
However, as to the Defendants, it shall be for three years from the date of the final judgment.
Reasons
Punishment of the crime
The Defendants: (a) left China through the introduction of F; (b) joined the International Telephone Financial Fraud (hereinafter “Singing”) organization; and (c) conspiredd the victims in many unspecified Korea with phone calls from the victims in financial institutions in accordance with the direction of the management staff, including G, to take charge of deceiving the victims and compelling the victims to transfer money to another person’s account.
1. The Defendants in common criminal conduct with Defendant A, C, and B, as well as other members of the non-organization within the organization, such as H, I, J, K, L, etc., the other Bosing Counselors, and misrepresenting the victim M with a telephone call from the apartment located in the Cheongyang-gu, China on February 6, 2017, and issuing the N Bank Loan Account in the name of the victim “I would like to issue the N Bank Loan Account of KRW 10 million working at the N Bank Loan Headquarters. As a result, the Defendants conspired with the employees of Bophishing, such as G, and deceiving the victim, thereby deceiving the victim.
2. The Defendants jointly committed with Defendant D, E, etc. shall be named as Defendant D, E, as well as other members of the non-organization within the organization, such as H, I, J, K, K, L, etc., which are different Bosing counselors, and in March 23, 2017, by misrepresenting the victim R by posting a telephone from the apartment located in the Cheongyang-gu, China, Cheongyang-gu, China, and assuming the person in charge of the loan of the N Bank S., and “N Bank S. ...
