Defendant shall be punished by a fine of KRW 5,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

1. Violence against the victim B;

가. 피고인은 2013. 10. 31. 00:30경 창원시 의창구 C, 301호 D 주점 내에서 혼자 술을 마시다가 종업원인 피해자 B(29세)에게 주점 여사장을 불러오라고 하였으나 피해자가 “누님(E)이 오늘 술에 취해서 집에 들어갔습니다, 진짜 없습니다 사장님” 이라고 말한다는 이유로, “E이 어디 있노, 니 거짓말 하는 거 아니가, 솔직하게 말해라, 불을 지르기 전에, 걸리면 직 인다, 니 내가 누군지 아나, 내가 깡패다, 봉곡동 실세다”라는 등의 욕설로 겁을 주며, 손바닥으로 빰을 1회 때리고, 발로 허벅지 부위를 1회 차고, 주먹으로 얼굴 부위를 4-5회 때리는 등으로 폭행하였다.

B. 가. 업무방해 피고인은 2013. 12. 18. 01:00경 창원시 의창구 G 피해자 F(36세, 여)이 운영하는 H 노래방 계산대 앞에서, 만취하여 찾아와 술을 달라고 하였으나 피해자가 “술에 많이 취했으니, 그냥 가시라”며 이를 거절하자 이에 기분이 나쁘다는 이유로 “노래방에 불을 지른다, 장사를 못하게 하겠다”라는 등의 온갖 욕설로 협박하고, 약 30분가량에 걸쳐 계산대 앞에 드러누워 뒹구는 등으로 행패를 부려, 피해자에게 위력으로 정상적인 주점영업을 방해하였다.
