Reasons
Punishment of the crime
[criminal records] Defendant B was sentenced to a two-year suspended sentence of imprisonment for embezzlement at the Seoul Western District Court on May 17, 2017 and the above judgment was finalized on the 25th of the same month. On August 31, 2017, Defendant B was sentenced to a two-year suspended sentence of imprisonment for fraud and a two-year suspended sentence of imprisonment for August 31, 2017.
9.8 The above judgment became final and conclusive.
[2] Defendant C Co., Ltd. is a corporation established for the purpose of construction with its head office in Seopo-si, Seopo-si, and is a business owner who has contracted a new construction of a detached housing complex in Ho in Seopo-si, Seopo-si, and has been executing construction with 15 full time workers.

B is the site director at the construction site of a new house complex with interest of the defendant C corporation.

A is the safety and health manager of workers who perform the work related to waterproof landscaping in the construction site of this case, with the interest of the business owner who subcontracted the works of waterproof and other construction works performed by the J, which was awarded a contract from Defendant C Co., Ltd. for the said construction works.
1. On October 2, 2016, around 07:30 on October 2, 2016, Defendant A had the victim K (47 taxes) perform the work of removing the scrap scrap metal installed in the outer window frame of the 7th floor of the said detached house by using the hander owned by the Defendant.
In this case, since there is a risk of danger to workers due to the leakage of electric machinery, the defendant, who is engaged in the safety management of workers, shall be in contact with the metal agents, the metal agents and the metal agents in order to prevent the danger of electric shock by water, and the workers shall take necessary measures to prevent accidents, such as having the workers use the hander with which the smoke is secured.
