Punishment of the crime

The defendant is the representative director of D Co., Ltd. in Kimhae-si.

From August 22, 2011 to September 25, 2013, the Defendant borrowed a total of KRW 494,000,000 from the injured party from the Small and Medium Business Corporation as a fund for supporting the start-up enterprise. On September 29, 2014, the Defendant offered CNC Venture Co., Ltd. (Mo, unit price: KRW 68,000,000, SK200), 2, CNC Master (Mo, 160,000, VX650/40), 39050,000, and 390,000, and 390,000, market price of the injured party as security.

In addition, on September 23, 2014, the Defendant borrowed KRW 372,00,000 from the Victim Co., Ltd. Busan Bank for the purpose of general funds from the Victim Co., Ltd. to the Busan Bank for the purpose of general funds at the actual branch of the Busan Bank located in 165, the Defendant offered KRW 73,576,000 as security on December 16, 2014 the amount of KRW 73,576,00 at the market price of D owned by D Co., Ltd. for the purpose of transferring two half lines, etc. of the total market price of KRW 91,834,00,00 to the Victim Co., Ltd. for the security of the Victim Co., Ltd.

On December 16, 2015, the Defendant borrowed KRW 66,400,000 from the Victim Nonghyup Bank Co., Ltd. as a general facility fund, and provided one of the 65,000,000, market price of which is 65,000,000.

Therefore, the Defendant violated his duty of care as a good manager to keep the above machinery, and violated it. On August 26, 2016, the Defendant sold 24 parts of the above machinery, etc. offered as security by transfer to E at the office of D Co., Ltd., a company around August 26, 2016 after receiving 121,00,000 won, such as the above machinery, etc. offered as security by transfer, thereby incurring property damage equivalent to 395,00,000 won to the injured Small and Medium Business Corporation, and total sum of 91,834,000 to the injured Busan Bank.
