A defendant shall be punished by imprisonment for not less than two years and six months.

However, the execution of the above punishment shall be suspended for four years from the date this judgment becomes final and conclusive.

Punishment of the crime

피고인은 2012. 12. 8. 17:40경 업무로서 C 스타렉스 승합차를 운전하여 경기 양평군 양평읍 양근리에 있는 ‘캠브릿지맴버스’ 앞 편도 2차로 중 2차로를 양평읍 방면에서 서울 방면으로 시속 약 60km로 진행함에 있어 그곳은 신호등 없는 횡단보도가 설치되어 있고, 전날 내린 눈으로 인해 노면이 미끄러운 상태였으므로 자동차 운전업무에 종사하는 자로서는 전방 좌우를 예의주시하고 조향 및 제동장치를 정확히 조작하여 안전한 속도와 방법으로 진행하여야 할 업무상의 주의의무가 있음에도 불구하고 전방주시 의무를 소홀히 한 과실로, 진행방향 전방 좌측에서 우측으로 횡단보도를 횡단 중인 피해자 D(77세)을 미처 발견하지 못하고 피고인 차량 앞 범퍼 및 본네트 부분으로 피해자를 들이받은 후 전방 도로에 쓰러진 피해자를 피고인 차량으로 역과하여 피해자로 하여금 즉시 그 자리에서 두개골파열및뇌탈출로 사망에 이르게 하고도 즉시 정차하여 피해자를 구호하는 등 필요한 조치를 취하지 아니하고 그대로 도주하였다.
