1. Of the instant lawsuits, 102 shares by the representative’s dismissal voting for each Dong, B apartment (1 complex) held by the Defendant on March 26, 2015.
Reasons
1. The following facts may be found in full view of the respective entries in Gap evidence 1 to 7 and Eul evidence 2 to 5 (including branch numbers), as well as the whole purport of pleadings:
The plaintiff was the defendant's member as the Dong representative of the Daejeon Seo-gu B Apartment Complex 1 (hereinafter "the apartment of this case") and was the defendant's member. The defendant is the council of occupants' representatives under the Housing Act composed of the occupants of the above apartment of this case.
B. On January 14, 2015, the Plaintiff attended an extraordinary meeting of the council of occupants’ representatives held at the meeting room of the instant apartment residents and deliberated on the members present and “cases concerning the management office operation, cases concerning controlled entity contracts, cases concerning the operation of insignia facilities, elevators, etc.,” but did not sign or affix seals on the minutes.
Accordingly, in the extraordinary session held on February 4, 2015, the above agenda was all subject to review, and the resolution was passed with the consent of the members after deliberation by the committee members, and the plaintiff signed the above extraordinary meeting minutes.
C. However, on February 16, 2015, a written consent to propose the dismissal of the above representatives including the Plaintiff, who are 106 representative representatives, was received to the Defendant’s election commission with the consent of at least 10% of the households of each Dong, 102, 103, 105, 106, 108, and 108, among the households of each Dong (20 households, total of 106 households) of the instant apartment. The reason for the proposal to dismiss the said representatives was as follows: (i) a violation of Article 51(4) of the Enforcement Decree of the Housing Act (Resolution of the Council of Residents), (ii) a violation of Article 30 (Minutes), (iii) a violation of the Management Rules under Article 33 (Duties and Responsibilities of the Council of Residents' Representatives) of the Management Rules (Article 51 of the Enforcement Decree of the Housing Act).
