1. Facts of recognition;

A. The plaintiff is a company operating industrial facilities, engineering and manufacturing business, etc., and the defendant is a company operating underwater construction business.

KONEXS Co., Ltd. (hereinafter referred to as "KONEX") is a company that manufactures, sells, etc. industrial machinery parts.

B. On March 16, 2016, the Defendant entered into a contract for the sales of goods between the Defendant and KONEX (hereinafter “SON Construction”)

(2) On April 1, 2016, KON entered into a sales contract with the Defendant for the following goods (hereinafter referred to as “PLEM”) to manufacture and supply the following goods (hereinafter referred to as “PLEM”) to the Defendant: (a) to deliver crude oil supplied through a water pipe’s trade name and tag in the above attached table repair work to the Defendant; (b) to the Defendant for the production and supply of the instant goods (hereinafter collectively referred to as “PLEM General”).

Section 1.(Goods Description and Contract Price) for the goods to be supplied to A shall be as follows:

2. Contract amount: 1,150,000,000 won (excluding value-added tax);

3. Period of payment under a contract: From April 1, 2016 to December 30, 2016: Criteria for payment by a principal contractor (payment in cash within 60 days from the date of receipt of the object):

5. Contract guarantee: 10% of the contract performance guarantee and 10% of the contract performance guarantee for defects (two years);
