Punishment of the crime

1. The Defendants committed the joint crime by conspiracy with each other in order in accordance with the instruction of one-person I, sold the pre-paid chips in the name of an influored name in an influor and delivered them for the purpose of telecommunication.

On September 9, 2015, at the office of Gangnam-gu Seoul Gangnam-gu Seoul J. 201, the Defendants posted an Internet “Internet chips and large phone sales” on the website, such as “Gulgle,” and reported this, and sold two pre-paid chips in the name of a person without a name to receive 500,000 won and provided them for the use of other persons’ communications.

The Defendants, in collusion with I, sold 147 prepaid chips in the name of the unclaimed in total of 74 times from around August 5, 2015 (from around September 2, 2015 to around October 29, 2015, the Defendants provided telecommunications services provided by telecommunications business operators for the purpose of communications by selling 2,8250,00 won (Provided, That the Defendant C sold 146 genetic chips in total at KRW 28,050,000) as shown in the list of crimes in the attached crime list.

2. No person who commits a single crime by Defendant A shall take over any medium of access to financial transactions or keep such medium knowing that it is to be used for a crime;

가. 피고인은 2015. 8. 경 서울 강남구 L 건물 408호 사무실에서 성명 불상 통장 판매업 자로부터 유한 회사 아 월기획 명의 우리은행 계좌 (1005-802- XXXXXX) 통 장 1개 등 접근 매체를 70만 원에 구입하여 양수하였다.

나. 피고인은 2015. 10. 초순경 서울 강남구 M 202호 사무실에서 I 등의 지시에 따라 범죄에 이용될 것을 알면서도 유한 회사 시 오나라 명의 농협계좌 (355-0037 -5899-XX) 통 장 1개, 유한 회사 드미 트리 명의 우리은행계좌 (1005-602- XXXXXX) 통 장 1개, 유한 회사 토파즈 명의 농협계좌 (351-0831 -5523-XX) 통 장 1개, 유한 회사 니 키 키 획 명의 농협계좌 (301-0177 -7153-XX) 통 장 1개 등 접근 매체를 성명 불상 자로부터 각각 전달 받아 보관하였다.
