피고인은 전남 영광군 C 소재 D버스터미널 부근에 있는 E약국 앞길에서 과일을 실은 1톤 화물차를 세워둔 채 그곳을 지나는 사람들에게 과일을 판매하는 사람인바, 2015. 5. 14. 11:00경 위 약국 앞길에서 과일을 판매하던 중 영광군청 안전관리과 소속 담당공무원으로부터 위 화물차가 주차방법을 위반하여 주차되어 있다는 이유로 과태료 고지서를 받게 되자 자신의 화물차만 단속된다는 생각에 화가 나 영광군청에 직접 찾아가 담당자에게 항의하기로 마음먹고, 같은 날 13:25경 전남 영광군 영광읍 중앙로에 있는 영광군청 안전관리과 사무실에서 미리 준비해 간 위험한 물건인 휘발유가 담긴 1.8리터들이 페트병을 손에 든 채 근무 중인 공무원들을 향해 “야 이 새끼들아, 나 혼자 죽을 줄 아냐, 다른 사람은 단속하지 않고 왜 나만 단속하고 그러냐, 같이 죽어보자.”고 소리치며 소란을 피우던 중 위 페트병을 왼손에 쥔 채 오른손에 든 라이터로 불을 붙일 것처럼 행동하여 그곳에 있는 공무원들을 협박함으로써 위험한 물건을 휴대하고 공무원들을 협박하여 공무원들의 민원업무 수행에 관한 정당한 직무집행을 방해하였다.
