A defendant shall be punished by imprisonment for one year.

Punishment of the crime

The Defendant is a person who served as an accounting member at the Seocho-gu E Apartment Management Office from January 3, 2006 to December 31, 2015.

When the above apartment residents pay the management expenses to a post office account (G) under the name of the "E Apartment Management Office" which entrusts the management of the victim FF corporation with the collection and custody of the management expenses, the defendant, according to the above entrustment, he kept the management expenses by the post office, and he, on his own, received the management expenses by falsely receiving and using the management expenses for apartment.

Around 1:00 on May 29, 2012, the Defendant: (a) requested a staff member of the Cheongdong-dong post office located in Seo-gu, Seo-gu, Seo-gu, Seo-gu, Seo-gu to pay wages to the said apartment management office and the Defendant; (b) took advantage of the fact that the Defendant directly receives the amount equivalent to the wages out of the above apartment management fees deposited in the post office account in the name of the above E apartment management office without any special verification procedure, from among the above apartment management fees deposited in the post office account in the name of the above E apartment management office; (c) even though the sum of the Defendant’s actual wages and the staff members of the management office in May 2012, 200 KRW 4,721,921, an employee of the above post office was under the name of the above E apartment management office, and (d) made a false statement of the transfer of wages to the Defendant’s account under the name of the above E apartment management office.

In addition, the Defendant received a total of KRW 149,756,233 through the aforesaid 43 times as stated in the list of crimes in the attached Table between that time and September 30, 2015, and acquired the money by remittance.
