피고인은 2013. 8. 14. 14:00경 스마트폰 채팅 사이트에서 피해자와 접속한 후, 피해자가 문자로 답을 보내는 데에도 시간이 오래 걸리고, 대답이 대부분 단답식이며, 몸 사진을 찍어서 보내라는 피의자의 요구에 아무런 저항 없이 가슴이 모두 나오는 상체 사진을 보내주는 등 정상적인 여성과 다르다는 사실을 알게 되었고, 같은 날 20:30경 피해자를 직접 피해자를 만나서 피해자의 말이 어눌하고, 대화할 때 대답이 일반인에 비하여 매우 느린 등 지체장애가 있다는 사실을 눈치챈 후 같은 날 21:00경 피해자를 천안시 동남구 F에 있는 ‘G모텔’로 데리고 가서 피해자에게 “나는 물리치료사다, 다리 마사지를 해 줄 테니 침대에 누워라”라고 말하여 피해자로 하여금 침대에 눕게 하고, 하의와 상의를 차례로 벗게 한 후 피해자를 1회 간음하였다.
