A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

On October 23, 2012, the Defendant was sentenced to eight months of imprisonment for violating the Act on the Aggravated Punishment, etc. of Specific Crimes, etc., in the Daejeon District Court's branch court, and completed the execution of the sentence on April 29, 2013.

1. Fraud;

A. On April 8, 2014, at around 23:50, the Defendant: (a) had the victim D’s “E (E)” operated by Chungcheongnam-gun, Chungcheongnam-gun; (b) had no money in water so that the Defendant had the intention or ability to pay the price even if he/she received an alcoholic beverage and alcohol from the victim; (c) had the victim induced the victim as if he/she did not have the intent or ability to pay the price; and (d) had the victim paid the price, and had the victim received an alcoholic beverage and food equivalent to KRW 200,000,000, as the female-lele one person.

B. At around 00:50 on August 24, 2014, the Defendant: (a) inducedd the victim G from the Chungcheongnam-gun F; (b) as if the Defendant did not have any money under water and received any alcohol from the victim even if he did not have an intent or ability to pay the price; (c) by deceiving the victim as if he did not have an intent or ability to pay the price; and (d) obtained pecuniary benefits equivalent to KRW 200,000, such as beer, beer, and beer, from the victim; and (e) obtained pecuniary benefits equivalent to KRW 60,000,000, as female-lele, as a single female-lele.

2. 공무집행방해 피고인이 제1의 나항과 같은 일시, 장소에서 술값을 계산하지 않는다는 신고를 받고 출동한 부여경찰서 I지구대 소속 경찰관 J이 사실관계를 확인하면서 피고인에게 사기죄로 처벌될 수 있음을 말하자 “그래 니들 맘대로 해, 씹할. 니들 K한테 술 얻어먹은 거 다 알아, 짭새 새끼들아.”고 욕설하였고, 이에 같은 지구대 소속 경찰관 L이 피고인을 현행범인으로 체포하면서 순찰차에 태우려 하자 “내가 징역 5년을 살다가 나왔는데 가만두지 않겠다. 니들 다 죽여 버리겠다.”고 말하여 협박하였다.
