1. The defendant shall be punished by imprisonment with prison labor for ten months;
2.Provided, That the above sentence shall be executed for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Around 21:20 on February 7, 2013, the Defendant was under the influence of alcohol with a blood alcohol content of 0.170%, and the Defendant was driving the Cunstst Pacific Cargo in the section of about 1km from the street before the mother-gun of Busan to the front of the plane captain’s sports center located in the front of the plane captain-gun of Busan.
2. Around February 21, 2013, the Defendant violated the Act on the Aggravated Punishment, etc. of Specific Crimes (Death or Injury resulting from Dangerous Driving) driven the said vehicle while drunk, and proceeded at a speed of 60km per hour from the Myeon of the plane captain police station to the Myeon of the Gun office of the Si/Gun, depending on two lanes from the four-lane road in front of the plane captain sports center in the direction of the Eup/Myeon in Busan Metropolitan City.

In such cases, a person engaged in driving of a motor vehicle shall not drive a motor vehicle in a state where normal driving is difficult due to influence of drinking, and there was a duty of care to safely drive the motor vehicle by checking the traffic situation, accurately manipulating the steering system, etc., and to prevent accidents by safely driving the motor vehicle.
Nevertheless, the Defendant neglected this and negligently driven a vehicle while driving in the same direction as it is while driving at the same time on two-lanes, and the part of the back end part of the EM vehicle driven by the victim D(50 years of age) with the front end part of the said EM vehicle. In other words, the victim FF (39 years of age) who was driving in front of the said string vehicle in the same direction while driving in front of the said string vehicle. The back part of the GM vehicle driven by the victim FF (39 years of age) who was driving in front of the said string vehicle was shocked into the front end part of the said string vehicle, and again, the said string vehicle was driven by the victim H (40 years of age) who was standing in the atmosphere due to the signal.
