피고인은 2013. 10. 9. 04:00경 이천시 B에 있는 ‘C’ 술집에서 술값 시비가 있다는 112 신고를 받고 출동한 이천경찰서 D파출소 소속 경사인 피해자 E에게 위 주점 종업원인 F 외 1명이 지켜보는 가운데, “병신새끼들 짭새새끼들 지랄하네 병신 꼴값 떠네 너 죽여 버린다”라고 큰소리로 말하여 공연히 피해자를 모욕하였다.
