1. Defendant A shall be punished by imprisonment with prison labor for six months and by imprisonment with prison labor for eight months;
2.Provided, That this judgment has become final and conclusive.

B On October 22, 2015, the Suwon District Court sentenced imprisonment with prison labor for a violation of the Labor Standards Act in the Suwon District Court's Pyeongtaek District Court's House on June 2, 201, and was finally sentenced to two years of suspension of execution on May 26, 2016.

B is the representative director of E Co., Ltd. established for the purpose of creating a complex, etc. (hereinafter referred to as “E”), and Defendant A is the chief of the construction industry of the said company.
사실 ㈜E 은 2013. 10. 21. 경 자본금 1,000만 원으로 설립된 후 2013년에는 4,198만 원의 손실이 발생하였고 2014년에는 세무신고가 안될 정도로 회사운영이 어려워 직원 급료와 용역 비 등의 채무도 지급하지 못하는 상황이었으며, 2014. 6. 경 오스트 레일리 아국 멜버른 소재 F 라는 금융회사로부터 대출을 위한 대출의 향서를 받았을 뿐 사업을 위한 부지 확보 등 정식 대출 계약서 작성을 위해 요구되는 조건을 충족하지 못하여 대출을 받을 수 없는 상황이었으므로, 피고인들은 피해자 주식회사 케이씨에스정보 피고인들의 방어권 보장에 실질적 불이익이 없으므로, 공소장변경 절차를 거치지 아니하고 피해 자를 공소장의 공소사실 기� 와 달리 인정한다.

Nevertheless, around June 2014, the Defendants conspired to make a promise to repay money through inducement of foreign capital in the office of the Dispute Resolution Co., Ltd. located in the third floor of G Building in Ansan-si, and to borrow money from the victim company. Defendant A, upon the direction of Defendant B, in accordance with the direction of Defendant B, promoted the inducing of foreign capital of the amount of KRW 1 billion in the E U.S. dollars to the representative of the victim company who is detained in the detention center located in Suwon-si, Suwon-si, Suwon-si, Suwon-si, Suwon-si, 176 in the middle of July 2014.
