A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

To the extent that it does not affect the defendant's exercise of the right of defense, the following facts charged are organized (D) and the facts charged are recognized.

1. The defendant is a person who is engaged in driving a franchiseer's vehicle in violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (i.e., escape vehicle) and the Road Traffic Act (ii).

On November 19, 2015, the Defendant driven the above car at around 18:52, and led to a three-lane road in the front of the Nowon-gu Seoul Special Metropolitan City, Seocheon-si, Seoul Special Metropolitan City, to drive the vehicle at about 20 km each hour at the speed of about 10km from the north-do private road.

The Defendant had a U-turn to proceed with the opposite line, and since there was a center line of yellow solid lines, there was a duty of care to make a U-turn at the point where the U.S. driver was permitted.

Nevertheless, by neglecting this, the injured party D (the 36-year old) who has changed the course from the three-lanes to the two-lanes of the six-lane each by the negligence of the central line, instead of neglecting it, received the front side of the FK5-car driving by the Defendant’s left side side after the Defendant’s car.

Ultimately, the Defendant, by occupational negligence, committed an injury to the victim, such as salt ties and tensions, which require two weeks of treatment, and at the same time, the repair cost, such as replacement of the front driver, destroyed the above K5 car owned by the victim E to the extent that the repair cost is 8.50,000 won, and escaped without taking necessary measures, such as stopping the vehicle and providing relief to the victim.

2. Violation of the Traffic Act on roads.

A. On November 19, 2015, the Defendant driven a Korean-style apartment parking lot located in 25 in Bupyeong-gu Incheon Metropolitan City, Bupyeong-gu, Incheon around 12:00, from around 20:00 on the same day to the home plug road located in Kimpo-si, Kimpo-si, Kimpo-si, and without obtaining a driver’s license for a motor vehicle in approximately 50km section.
