[Crimes related to the Ulsan Jung-gu P Housing Redevelopment Project]

1. Defendants A, B, and C are the substantial representatives of R (hereinafter “R”) management business entities specialized in maintenance and improvement projects that support administrative affairs, such as reconstruction in Q and second floor in Ulsan-gun, Ulsan-gun, and redevelopment projects, and the selection of a contractor for redevelopment projects; Defendant B is the president of R; Defendant C is the former president of R; and Defendant C is the president of Ulsan-gu P (a total of 329,561 square meters) from April 201 to the head of the housing redevelopment and improvement project partnership’s association in Ulsan-gu P (a total of 329,561 square meters) is a person who performs overall duties of the above union, such as the selection of a specialized maintenance business entity, a contractor, etc.; and management of the partnership’s property.

Defendant

On December 2, 2013, A, with the introduction of Defendant C, intended to select S as a specialized management company of the rearrangement project that will provide administrative support, such as the selection of the construction work of the said union, in U.S., at U.S. around U.S. on the same day, A, by imposing excessive bidding conditions for prepayment of KRW 300 million in tender bond or submission of performance guarantee insurance policy of KRW 300 million in advance, and prevented the application for bid in advance to the other company. In order to meet the conditions of competition, A was the most applicant company of the rearrangement project in one place other than R, and Defendant A was approved by reporting this on the same day to the Defendant B, the chairperson of the said union.

After that, on February 24, 2014, the said union issued a notice of bid to a specialized maintenance management company with the terms and conditions as above as “3.17, 2014.” Defendant A, on March 13, 2014, submitted R’s tender application documents with a 12,070 won per 1m2,070 square meter of services costs to the person in charge at the office of the said association located in Ulsan-gu, Ulsan-gu, Seoul, to the person in charge, and on March 17, 2014, submitted the documents for tender application to the person in charge at the office of the said association located in the same five-story-gu, Ulsan-gu, the first applicant company as the highest bidder company. On March 17, 2014, the bid application documents with 14,900 won per 1m2,00 won per 1m2, and the Seoul Guarantee Insurance Co., Ltd, which was forged in advance (tender).
