Reasons
Punishment of the crime
[2014 Highest 2050] The Defendant issued a summary order of a fine of KRW 2.5 million at the Seoul Western District Court on November 9, 2009, and a fine of KRW 3 million at the Gwangju District Court on October 25, 2012 for the same crime.
1. Around April 24, 2014, the Defendant violated the Act on the Aggravated Punishment, etc. of Specific Crimes (Death or Injury caused by Dangerous Driving) and the Road Traffic Act (driving a sound driving) led the Defendant to drive a vehicle with a blood alcohol concentration of 0.266% under the influence of alcohol at 0.26% in the direction of the Seo-gu Standing, Seo-gu, Gwangju, by driving a vehicle with C benz E200, bypassing it from the right edge of the call forum bus to the viewing on a speed of about 5 km per hour.
Since there are many vehicles parked on the street and many traffic volume, so in such a case, there was a duty of care to operate the steering gear and brakes properly by properly manipulating the steering gear and the brakes as a person engaged in driving of the motor vehicle.

2. On April 24, 2014, the Defendant was arrested as a flagrant offender of a violation of the Road Traffic Act from G of the F District of the Gwangju Western Police Station and from a slope H at the place described in paragraph (1) at around 01:30.
