Defendant shall be punished by a fine of five million won.

If the defendant does not pay the above fine, KRW 100,000.

Punishment of the crime

1. On March 2014, the Defendant: (a) stated “Seoul Metropolitan Government D” in the column for the location of the real estate lease agreement form in the new town (hereinafter referred to as the “Seoul Metropolitan Government”); (b) in the column for the content of the contract, “3 million won for guarantee; (c) December 25, 2012” in the temporary column for the contract, “ Address E606, name F; and (d) the lessee’s address address D, name D, and name A” in the column for the lessee, and affixed F’s seal to the lessor F.

For the purpose of exercising, the Defendant forged a copy of a real estate lease agreement in the name of F, a private document on rights and obligations.

2. On March 6, 2014, the Defendant: (a) borrowed money from H coffee shop located in Songpa-gu Seoul, Songpa-gu, Seoul; (b) presented a forged real estate lease agreement as security to C, as described in paragraph (1).

3. On the date, time, and place set forth in paragraph 2, the fraud Defendant presented a forged real estate lease agreement to the victim C, stating that “If the Defendant lends KRW 70,000,000,000,000,000,000,000,000,000 won, to be provided as security, it shall be used for about six months, and the interest shall be paid KRW 60,00,00 per month.”

However, in fact, the defendant did not hold the claim for the return of the lease deposit amounting to KRW 70 million on the D real estate in Eunpyeong-gu Seoul Metropolitan Government as stated in the lease contract stated in paragraph 1, and was merely forged without the consent of F.

Nevertheless, the defendant presented a forged real estate lease agreement and deceiving the victim as if he had a claim for the refund of deposit equivalent to KRW 70,000,000,000, and then, he/she is 9,50,000,000 around March 6, 2014, and KRW 9.5 million in total around March 7, 2014, and KRW 19,000,000,000.
