Examining the reasoning of the judgment below in light of the evidence duly admitted by the court below, the court below is just to have found theO guilty of violation of the Act on the Aggravated Punishment, etc. of Specific Economic Crimes (Fraud) and fraud and special assault against AO among the facts charged in the instant case (excluding the part without charge) on the grounds stated in its reasoning, and contrary to the allegations in the grounds of appeal, the court below did not err by misapprehending the legal principles on fraud, violation of the Act on the Aggravated Punishment, etc. of Specific Economic Crimes (Fraud), special assault, and burden of proof, or by violating the rules of evidence.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
