The judgment of the court below is reversed.

Defendant shall be punished by a fine of KRW 5,000,000.

The above fine shall not be paid by the defendant.

A. Although the Defendant was erroneous in understanding the facts and did not have any intention to commit perjury, the lower court rendered a guilty judgment among the facts charged in the instant case. In so doing, the lower court erred by misapprehending the facts.
