피고인은 2019. 1. 5. 14:05경 성남시 수정구 B 소재 “C” 안에서 아무런 이유 없이 소란을 피우다가 112 신고를 받고 출동한 D지구대 소속 경위인 피해자 E로부터 귀가할 것을 요구받자, 위 약국 앞에서 피해자에게 “씨발놈아, 양아치 새끼, 개병신, 니 애미가 그렇게 가르쳤냐, 경찰 쫄다구 새끼가 건방지게 까분다, 내 아들이 검사다”라고 욕설하는 등 공연히 피해자를 모욕하였다.
