A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Reasons

Punishment of the crime

1. No person who violates the Act on Special Cases concerning Regulation and Punishment of Speculative Acts, Etc. shall engage in speculative acts as a business by using slot machines or speculative gaming machines, other than speculative business;

Nevertheless, upon receipt of a request for the settlement of points obtained from customers who completed a game at the time and place stated in Paragraph 1, the Defendant carried out an act of exchanging intangible results obtained through the use of the game product in a way of exchanging the remaining amount after deducting 10% of money exchange commission from the amount converted into 10,000 won per 4 points.
