Defendant shall be punished by a fine of KRW 700,000.

If the defendant fails to pay the above fine, 50,000 won shall be one day.

1. 2013. 5. 5.자 범행 피고인은 2013. 5. 5. 03:30경 부산 중구 남포동에 있는 상호불상의 주점에서, 피해자 C이 피고인의 여자친구인 D에게 피고인을 비방하는 내용의 카카오톡 문자를 보냈다는 이유로 화가 나, 피고인의 휴대폰을 사용하여 피해자의 휴대폰으로 카카오톡 채팅을 통해 “조심하이소 다치기 시르면 ^^ 죽는 수가 있소”, “당신 내를 우습게 아는데 당신 하나 회 뜨는 거 별거 아님 ^^”, “학교에서 띄면 반 죽여 드릴께요 ^^”, “죽고 싶나, 찾아가까 지금”, “가까 지금 죽여줘 ”, “학교에서 봅시다. 눈에 띄면 쥑이삔다 개세야”라는 내용의 문자를 보내어 피해자를 협박하였다.

On May 8, 2013, the Defendant, at around 17:00 on May 8, 2013, expressed the attitude that the Defendant was able to take the Defendant’s drinking to the victim C at the front G coffee set parking lot located in Busan Seo-gu, Busan, and there is no “Sk-in, .. & sk-in k-in, and there is no container. However, the Defendant threatened the victim by stating that the Defendant would not have any more snow than once.”

1. The crime of intimidation is not established because sending each of the above text messages to the Defendant on May 5, 2013 is difficult to view it as a threat of harm and injury likely to cause a general fear.
