A defendant shall be punished by imprisonment for not less than one year and six months.

Of the facts charged in the instant case, the point of fraud on December 14, 2006 and October 10, 2006.

Punishment of the crime

On June 3, 2009, the defendant was sentenced to six months of imprisonment for breach of trust in Busan District Court's Dong branch court's decision on June 11, 2009 and became final and conclusive on June 11, 2009.

Since the mid-190s, the Defendant: (a) from around the mid-199 to the mid-25 members of the 25th century, paid the guidance money of KRW 400,000 per month; (b) while operating the 500,000 won system by which the fraternity paid the guidance money of KRW 10,000 from the mid-205 to the beginning of the 1990s, the Defendant was unable to pay the guidance money due to economic circumstances, etc.; and (c) the Defendant was unable to pay the money from the other persons as a result of the occurrence of the fraternity from the mid-2005 to the nearest; and (d) there was no intention or ability to pay the guidance money in a normal manner even in the process of preventing the repayment of the money borrowed from another person, by accumulating a large amount of debt, or by borrowing the money from another person.

[2014 Highest 1465] On September 3, 2007, the Defendant: (a) made a false statement that “if other members of the community lend KRW 10 million to require supply, the members of the community will be paid with other fraternitys; and (b) received KRW 10 million from the victim’s Busan Bank account in the name of the Defendant.”
